Terms of Use
Last updated: 29 October 2026
These terms are an agreement between you and Novara LLC, a Virginia limited liability company ("Novara", "we", "us"), the maker of Bhoto. They cover the Bhoto iPhone app and the website bhoto.app. By using either, you agree to them. If you don't agree, please don't use Bhoto.
Apple's Licensed Application End User License Agreement (the "Apple EULA") also applies to the app. If these terms and the Apple EULA conflict, the Apple EULA wins on anything it covers.
Who can use Bhoto
You must be at least 18 years old. Where the law requires it, Bhoto confirms your age with Apple's age check when you start. Bhoto is for personal, non-commercial use.
Your photos and data
- Use Bhoto only for photos of yourself. Don't add photos of anyone else without their consent, and never of anyone under 18.
- Everything you add stays on your device. You own it. We can't see it, recover it or delete it for you.
- Keep a backup. If you delete the app or lose your phone without a backup, your photos are gone and we can't get them back.
- You're responsible for anything you choose to share. Automatic face and body covers are a best effort and can miss something. Always check the preview before you share.
Our Privacy Policy explains what we do and don't receive.
Not medical advice
Bhoto is a photo and weight diary. It doesn't diagnose, treat or advise on any health condition, and any trend, pace or note it shows is a record of what you entered, not advice. Talk to a doctor before changing your diet, exercise or medication, including weight-loss medicine. If tracking your body is making you feel worse, take a break. If you're struggling with eating or body image, you can find free, confidential support at findahelpline.com.
Bhoto Pro and the free trial
- Tracking is free. Bhoto Pro adds extra tools (such as before and after comparisons and videos) for a single payment, with the price shown in the app before you buy. It isn't a subscription: nothing renews and there's nothing to cancel.
- Pro comes with a free 2-week trial, once per Apple Account. The trial never charges you. When it ends, the Pro tools lock until you buy Pro; your photos and everything free stay as they are.
- Apple sells Pro and handles payment, under Apple's terms. Pro is tied to your Apple Account and comes back on a new iPhone with Restore purchases. It can't be shared through Family Sharing.
- Refunds are handled by Apple under Apple's policies (reportaproblem.apple.com). Nothing here limits any right to cancel or get a refund that you have under the law where you live.
- Without Pro you keep every photo, can keep tracking, and can always export everything.
- Updates are included. We may change, add or remove features over time, but we won't take away a Pro feature you've bought without a good reason, such as a change in the law or in iOS.
Using Bhoto fairly
You agree not to:
- break any law, or use Bhoto to create, store or share sexual images of anyone under 18;
- add or share images of other people without their consent;
- copy, modify, resell or reverse-engineer the app, except where the law allows it;
- try to get around the age check, the purchase system or any security feature.
Our app and brand
The app, its design, the name Bhoto and its logo belong to Novara. We give you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, as allowed by the Apple EULA. If you send us ideas or feedback, we may use them without owing you anything.
Things outside our control
Bhoto runs on iOS and uses Apple's services (the App Store, iCloud Backup, the photo picker, the share sheet). When you share to another app, that app's terms apply. We're not responsible for other companies' services.
Disclaimers
Bhoto is provided "as is" and "as available". We work hard to keep it reliable, but we can't promise it will always work without errors, that photos will always line up perfectly, or that automatic covers will catch everything. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
Limits on our liability
To the fullest extent the law allows, Novara isn't liable for any indirect, incidental, special or consequential damages, or for lost photos or data, and our total liability for any claim about Bhoto is limited to the greater of what you paid for Bhoto in the 12 months before the claim or US$50.
Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud. If you're a consumer in the EU, UK or another country whose laws give you rights that can't be waived, you keep those rights, and the limits above apply only as far as your law allows.
Ending
You can stop using Bhoto at any time by deleting it. We may stop offering Bhoto or end your use if you seriously break these terms. The sections about ownership, disclaimers, liability and law continue after that.
Law and disputes
These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-law rules. Disputes go to the state or federal courts located in Virginia, and you can also use small-claims court where you live. If you're a consumer outside the United States, you keep the protection of the mandatory laws of your country and can bring a claim in your local courts.
Changes to these terms
We may update these terms. We'll change the date at the top and, for important changes, say so in the app's release notes before they take effect. If you keep using Bhoto after that, the new terms apply.
Other terms
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we haven't given up the right to. You can't transfer these terms to someone else; we may transfer them to a company that takes over Bhoto. These terms, the Apple EULA and our Privacy Policy are the whole agreement between you and us about Bhoto.
Terms Apple requires
- Who you're dealing with. These terms are between you and Novara only, not Apple. Novara, not Apple, is responsible for the app and its content.
- Licence. Your licence to use the app is limited to using it on Apple products you own or control, as allowed by the App Store's Usage Rules.
- Support. Novara, not Apple, is responsible for providing support for the app. Apple has no obligation to provide any maintenance or support.
- Warranty. If the app fails to meet any warranty that applies, you can tell Apple, and Apple will refund the price you paid for it (if any). Apart from that, Apple has no warranty obligation for the app, and any other claims, losses or costs from a failed warranty are Novara's responsibility, to the extent the law allows.
- Claims. Novara, not Apple, is responsible for any claims about the app, including product liability claims, claims that it doesn't meet a legal or regulatory requirement, and consumer protection, privacy or similar claims.
- Intellectual property. If someone claims the app or your use of it infringes their intellectual property, Novara, not Apple, is responsible for investigating, defending, settling and resolving the claim.

- Third-party terms. You must follow any third-party terms that apply when you use the app.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, have the right to enforce them against you.
